The Failure of the 28-Clause Peace Initiative for Ukraine: How Peace Negotiations Continue to Stumble

Europe breathed a deep collective sigh of relief on Monday, as the tension triggered by the presentation of a new comprehensive peace framework for resolving the conflict appeared – momentarily – to have been stabilised. A American diplomat spoke of "significant advancement" after Ukraine-US talks in Geneva. On Monday night, Russian leadership made its response: an extensive attack of missile and drone strikes on Kyiv.

The Cycle of Negotiation and Warfare

The succession of opposing developments captured the grim essence of the recent timeframe. By day, political struggles are fought: positive announcements are issued from different nations. Immense energy is allocated on restraining certain initiatives. By night, Moscow clearly shows the world that, for them, military action persists as the primary tool for achieving "settlement".

After-Dark Attacks

As the offensive progressed into the early hours of Tuesday, the current condition of Ukraine's exposure was laid bare. Ukraine is capable of detecting rocket firings from across the border, a capability provided through up-to-date information. From observation points, defense planes that had been scrambled to intercept incoming aerial threats roared overhead – modern combat jets delivered to Ukraine by European allies.

Shortly after, Kyiv's missile defense thundered: several firings deployed against a hostile projectile. This was a advanced protection mechanism at work, probably delivered by allied countries. Every deployment jolts you unexpectedly, causing tremors. The moment of terror quickly transforms into resigned acknowledgment: perhaps the incoming missile won't hit its mark this time, sparing the city from devastation and additional electricity failures.

Ongoing Risks

Following this, a heavy machine gun engaged a drone somewhere nearby, part of a rapid response unit – most likely Western-made equipment. Unfortunately, the bullets missed the opposing UAV – it continued its flight toward its objective.

With pauses, this carried on until dawn. Kyiv faced the early updates: multiple fatalities, damage and infrastructure problems in multiple buildings as a result of the evening attack. As always, everyone still maintained normal activities – experiencing conflict. But those 24 hours demonstrated Ukraine's critical military reliance on external assistance – a need that neighboring countries are evidently unprepared to fill in the near term.

Unsuccessful Negotiations

The 28-point plan from Washington generated strong feelings, controversy and serious worry – and briefly redirected concern from Ukraine's major integrity crisis in years. Yet, we have witnessed similar scenarios, after prior negotiation attempts and bilateral conferences.

Every new proposal from Washington adheres to the consistent cycle: a negotiation push against Ukraine, which Kyiv, with allied governments, manages to fend off. They stabilise the situation but never actually achieve victory. This pattern will, undoubtedly, endure.

Tactical Assessments

It is tempting to accuse particular leaders of repeatedly advocating Kremlin's demands. But that does not seem to be the complete picture. American leadership works based on a premise familiar among experienced diplomats: you cannot achieve through diplomacy what you have lost on the battlefield. The American government presumes that it is unfeasible to force Russia to abandon the territory that it presently holds in Ukraine's south or east.

The challenge is that while acknowledging this situation, US leadership does minimal to deter Moscow, through words or deeds, from thinking that the situation will not change more in its benefit in the coming year.

Divergent Views

Therefore, Moscow is confident that time is on his side – that Ukraine and its supporters are coming close to fatigue. Their reason to accept conditions that does not give them the largest achievable advantage is virtually nonexistent. There may be multiple initiatives to stop fighting, but they will carry on as long as Russia's leader remains supremely confident in the conclusion.

On the contrary, Ukrainian leadership believes that Ukraine can still endure, progressively conceding lives and land but avoiding a complete military breakdown until conditions improve in its benefit.

Present Conditions

Objectively, there are no actual prerequisites for a truce. Now, subjective factors are becoming relevant: leadership ambitions to negotiate peace and achieve global acclaim, and the government's double obstacles – on one hand, not to estrange crucial supporters, and on the other, to rally Ukrainians around the flag against any plan Kyiv finds unacceptable, so that their priority does not shift toward internal issues. And although their objective will now be considerably more difficult after current events, it remains quite doubtful that this will modify their basic position.

These conflicting dynamics are influencing discussions.

Assessment and Future

It took a only one week to terminate the 28 points of the current initiative. Assertive and inconsistent approach of the matter by US administration, opposition by Ukraine and the rest of Europe, along with calming attempts of negotiators, and finally, latest revelations, all achieved their purpose.

While new proposals based on old ideas are imminent, Kyiv, London and other European capitals should reach an essential realization: Ukraine and Europe will only be able to fend off political attacks from Washington that are rooted in Kremlin requirements and show particular unwillingness to alter the situation, if they remain united and improve their protective measures at a significantly accelerated rate. If they do, neither external pressure nor military threats will be able to defeat them. In the meantime, Ukraine's capability to repel nightly air assaults will, for the predictable period, primarily depend on sustained allied backing.
